Know all men by these presents that I Daniel Shelly late o f Clinton County Kentucky do make and publish this my las t will and testament being in my right mind and believing m y time soon will close in this time world. First I submit m y sole and body to my wise creator Second after my Decd . I want my just debts settled I wish my wife Margaret Shel ly to have all my household and kitchen furniture and all t he stock that we may have on hand also my tract of land whe re I now reside during her natural life with the exceptio n of a small piece of the south side including a tobacco ho use and ravine with a gully about half way up the hill then ce south crossing a branch in the line of Guyons Shellys gi ving it to that piece of land that I gave to my son Guyan S helly this small piece of land above mentioned I give to m y son-in-law David Booher At the Dec'd of my wife Margare t Shelly I bequeath to my Emily Crawley the balance of th e tract of land where I now reside - I give to the heirs o f my son McCampble Shelly Dec'd my mill including about fif teen acres of land at the Dec'd of myself and my wife Marga ret Shelly I further wish that the land I swoped James T. A shenhurst to stand as we made the trade & I impower John H . Wright my son in law to make title to James T. Ashenhurs t - I further wish John H. Wright to make title to David Bo oher to the land that I give to my son Gyan Shelly with th e peace above mentioned of my home tract as witness here wi th I set my hand this 30th Day of Oct. 1865

This Indenture made and concluded this third day of Decembe r in the year of our Lord one thousand eight hundred and te n between Strother Frogg of the county of Cumberland and St ate of Kentucky of the one part and Peter Shelly of the sam e county and State of the other part witnesseth that fo r a valuable consideration to the said Frogg in hand paid h e has hereby bargained sold alien and conveyed and by thes e presents do bargain sell alien confirm and convey unto th e said Peter Shelly a certain tract of land Situate lying a nd being in the county and State afore on the South side o f Cumberland river on the head waters of Illwill and bounde d as followeth, Towit, Beginning on a black Walnut Thenc e N 20 West 169 poles to a dogwood Thence N 69 East 169 pol es to a black oak and maple Thence S 21 East 148 poles t o a forked dogwood corner to John Richardson Thence wit h a line of said Richardson South 69 W 64 poles to a popla r Thence S 21 E 29 poles to two Gums Thence S 69 W 55 pole s to a post oak Thence South 40 poles to a white oak and Gu m Thence West 72 poles to two dogwoods Thence N 4 E 13 pole s to a poplar and black oak Thence N 72 E 20 poles to a Wal nut the Beginning corner containing by computation two hund red acres with all and Singular the appurtenances thereunt o belonging or in any wise appertaining which said tract o f land was granted unto James W. Taylor assignee of the Jus tices of the Cumberland Academy by Patent bearing date th e 5th day of July in the year of our Lord 1808 and which sa id tract of land I the said Strother Frogg for myself my he irs the aford tract of land unto the said Shelly his heir s do warrant and defend from myself my heirs and from the c laim of the aford Cumberland Academy and all legal claims I n witness whereof I have hereunto set my hand and seal th e day and date above written.

State of Kentucky Cumberland County Court Clerks Office 1 5 th day of February 1811 I Edward King a deputy clerk of t he Court for the county afore said do hereby certify that S trother Frogg a party to the within Deed of bargain and sal e from himself to Peter Shelly came personally before me i n my Office on the 11th day of February 1811 and acknowledg ed the Same to be his act and Deed and that I have recorde d the same together with this my certificate in my said Off ice in Liber B at page 83 witness my hand the day and yea r first above written.
