Last Will And Testament

Know all men by these presents that I, Daniel Shelly late o f Clinton County, Kentucky make and publish this my last wi ll and testament being in my right mind and believing my ti me given will close in this world - First I submit my sou l and body to my Wise Creator, Second after my death I wan t my just debts settled. I wish my wife Margaret Shelley t o have all my household and farmhouse and all the stock tha t I may have hand also on tract of land where I now resid e during her natural life with the exception of a small pie ce of the south side including a tobacco house and spring w ith a gully about half way on the hill thence south crossin g a branch in the line of Shelleys giving it to that piec e of land that I gave my son this small piece land above me ntioned. I give to my son-in-law David Booher. At the hee d of my wife Margaret Shelley I bequeath to my ___ Crawle y the balance of the tract of land where I now reside. I g ive to the heirs of my son Mecanble Shelley my will includi ng about fifteen acres of land at the deed of myself and m y wife Margaret Shelley. I further wish that the land tha t I sold to James T. Ashenhurst to stand as we made the tra de and I in power of John H. Higgen my son-in-law to mak e right with John H. Higgen. I further wish John H. Wrigh t to make a right to David Booher to the land that I give t o my son ___ Shelley with the peace above mentioned of my h ome tract as mentioned here. I set my hand this 20th day o f Oct, 1865.

Smit h, and Nathan Smith the subscribing witnesses thence to th e court. This indenture made and entered into this 30th day of Octob er one thousand eight hundred and sixty five between Danie l Shelley and John H. Wright of the first part and Lewis L . Shelley of the second part all of the county of Clinton a nd state of Kentucky. Witnesseth that the said Daniel Shel ley and John H. Wright in consideration of the sum of two h undred dollars to have paid have this day granted bargaine d and sold and by these presents both give ground bargain s ell and convey unto the said Lewis Shelley a certain trac t or parcel of land lying and being in the county and stat e aforesaid on Illwill Creek and bounded as follows: Begin ning at a white oak thence N48W15 poles to a dogwood and wh ite oak thence N6W27 poles to a poplar thence N8W1 poles t o two ash trees one standing on each side of small branch t hence due west 21 poles to a white oak thence N10W36 pole s to a spotted oak thence N27W8 poles to a white oak thenc e N30W20 poles to a gum thence due north 5 poles to a hicko ry and a white oak thence S70W24 poles to a white oak and b eech thence S12W34 poles to a spotted oak white oak and o r beech thence S43E65 poles to an ash sugar tree thence S25 E65 poles to a white oak and thence S25E80 poles to walnu t and thence S63E14 poles to a black oak and thence S25E1 3 poles to three ashes and two dogwoods thence S20 E67 pole s to a stake in the Burkesville road and two black oaks mar ked thence along said road due eat S40E14 poles thence bear ing said road S71E45 poles to a beech thence S51W35 poles t o a white oak thence S68W29 poles to the beginning.
