(handwritten note on this document says the Judge is the so n of Jesse Smith the son of Alexander Smith.)
James Turner is said to be from Shipley, Kentucky in one bo ok on Cumberland County (S. E. Clinton Co.)

1880 Census Lucinda states her father is born in Tennessee ? James said North Carolina to the Census takers. There w as a section of Tennessee and North Carolina that was India n land and hadn't been claimed by either state in 1810.

The name James Turner Smith is listed as "Turner" in the Bo ok "History Of Cumberland County" indicating most likely th at Turner was not his legal given name. More than likely i t was a nickname or a name picked up along the way.

It is said that during the Civil War that James was too ol d to serve in the armies. One day a troop of Confederate s oldiers came by his farm looking for horses for the army . They had heard his was a horse farm. When they got ther e they took all of James' horses. Not long afterwards th e Union Army came by the farm for the same reason. They as ked James for his horses. James had no horses. They got up set at him thinking perhaps he was hiding the horses and th e argument escalated to the point that they were going to h ang him. A rope was thrown over a tree and the noose place d around his neck.
